Tampa Bay has been at the center of Florida's windshield claim fights for years, and the state rewrote its glass law in 2023 partly because of it. Here is what the law says now, read from the statutes, and a list to work through before, during and after a claim.

Why Tampa

Why this matters here more than most places

In 2017 the business magazine Florida Trend wrote that windshield claim schemes were "most rampant in the Tampa Bay area." The same piece cited Florida's Insurance Commissioner, David Altmaier, reporting 19,000 lawsuits over assigned windshield claims statewide in 2016 alone.

The stories have not stopped. Tampa Bay 28's I-Team has shown a glass salesman approaching drivers in Tampa dealership service lanes during oil changes, calling small chips dangerous and saying a claim would not touch their rates.

None of this means a glass claim is a bad idea. In Florida, with comprehensive coverage, the windshield deductible does not apply, and that is the law working as written. It means you should know what you are signing.

The 2023 law

What changed, statute by statute

Read on the Florida Senate's statutes site on October 16, 2026. Quoted words are the statute's; the right-hand column is our plain reading. Your own policy wording still decides your claim.

Florida statutes that govern a glass claim in 2026
StatuteWhat it saysWhat you do with it
§ 627.7289On policies issued or renewed on or after July 1, 2023, an agreement assigning your glass benefits to a shop is "void and unenforceable."Nobody needs you to sign your claim over. If a form says "assignment" or hands the shop your benefits, don't sign it.
§ 559.920(17)A repair shop may not offer "a rebate, gift, gift card, cash, coupon, or any other thing of value" for making a glass claim, calibration included. People paid to sign up claims are covered too.Any gift for filing is a red flag, whoever offers it and wherever they stand.
§ 559.920(18)A shop must give you electronic or written notice, in at least 12-point type, saying whether your car's driver-assistance system needs calibration after the glass work.Ask for the notice before the job. If calibration is needed, it should be done to the vehicle maker's specifications.
§ 627.7291On a personal auto policy, the insurer "may not require" you to use a particular company or location for windshield work.Your insurer can suggest a shop. Check your policy for a discounted repair arrangement you agreed to, which is the exception.
§ 627.7288On a Florida policy with comprehensive coverage, the deductible does not apply to the windshield.$0 Deductible with Comprehensive Coverage applies to the windshield only. Door, back and roof glass use your policy deductible.

§ 627.7291 also says it creates no private right to sue. It sets the rule; it does not hand you a lawsuit.

Before you file

Five checks before anyone touches the glass

  • Look at the damage yourself, in daylight. Someone who finds you in a parking lot or a service lane is selling, so get a second look before you decide.
  • Open your declarations page and find comprehensive, sometimes listed as other than collision. Without it, the windshield rule does not apply to you.
  • Call your insurer or open its app and start the claim yourself. Keep the claim number.
  • If a caller says your windshield is part of a recall or needs a follow-up replacement, hang up and call your insurer or your dealer yourself before agreeing to anything.
  • Never give your policy number to someone you didn't contact first.

On the day

Read it before you sign

  • Read the whole work order. Look for the words "assign", "assignment" or "benefits", and ask what each clause does.
  • Check that the work order names your car, your VIN and the glass you were told about.
  • Ask for the calibration notice in writing, in print you can read. It should say whether your camera or sensors need calibration.
  • Turn down any gift, voucher or payment for the claim, however it is worded.
  • Take a photo of everything you sign.

With us you get the written calibration notice the law requires, and nobody asks you to sign a claim over.

After the install

Check what was billed in your name

Once the claim closes, ask your insurer for the paid amount and the shop's invoice. Compare it with what you were told: one windshield, the calibration if it was needed, the moldings for your car. Florida also makes it a violation for a repair shop to alter a customer's contract, estimate or invoice fraudulently, under § 559.920(6).

If something on the bill looks wrong, call your insurer first. Florida's Department of Financial Services has a consumer services division for insurance questions, and its auto insurance FAQ explains the assignment ban in plain words.

Will a glass claim change your premium? That is your insurer's question to answer, and nothing in these statutes decides it. Be wary of anyone in a parking lot who promises one way or the other.

How we do it

A claim through Bang AutoGlass

You open the claim with your insurer, and we help you file by giving them the glass details and our information when they ask. The claim stays yours. We check your coverage before booking, say what, if anything, you would owe, and after covered work we bill the insurer directly. We offer nothing of value for a claim, and we never waive, cover or refund a deductible.

Someone at my dealership said my chips are dangerous and the windshield would cost me nothing. What should I do?

Say you will think about it and leave. Look at the damage yourself, check your policy for comprehensive, and start any claim with your insurer directly. A decision made in a service lane can wait a day.

I signed something in a parking lot. Can I cancel?

Call your insurer and tell them you did not authorize the claim, then tell the shop in writing. On a policy issued or renewed since July 1, 2023, an assignment of glass benefits is void under § 627.7289.

Does every new windshield need a calibration?

No. It depends on the car and the camera or sensors behind the glass. Florida requires the shop to tell you in writing whether yours needs one.
