The statutes

Florida glass law, point by point

Read on the Florida Legislature's site on October 16, 2026. Quoted words are the statute's own; the rest is our plain reading. The wording of your own policy still governs the claim.

Florida statutes behind a Tampa Bay windshield claim
StatuteWhat it saysWhat it means on your claim
Fla. Stat. § 627.7288On a Florida policy with comprehensive (or combined additional) coverage, the deductible “shall not be applicable to damage to the windshield.”$0 Deductible with Comprehensive Coverage is the shorthand. A liability-only policy is not included, and the rule names the windshield alone.
Fla. Stat. § 627.7291Under a personal lines auto policy, an insurer, agent or adjuster “may not require a claimant to use a particular company or location” for windshield replacement, repair or calibration. For a windshield on your personal policy, your insurer can suggest a shop but may not require one. If you accepted a discounted policy with a set repair arrangement, check that part of your policy.
Fla. Stat. § 627.7289On policies issued or renewed on or after July 1, 2023, assigning glass benefits to a shop is void. You remain the claimant. We never ask you to sign your claim over.
Fla. Stat. § 559.920(17)Florida bars glass shops from offering anything of value, such as cash, a rebate or a gift card, for making a glass claim.Nobody should hand you a gift for filing. If anyone offers one, at a dealership lot or a gas station, say no.
Fla. Stat. § 316.610Police may stop a vehicle they have reasonable cause to believe is unsafe. In Hilton v. State (2007), the Florida Supreme Court held that a cracked windshield breaks the statute only if it makes the car unsafe.

Door, back and sunroof glass are outside § 627.7288. Those claims go under the deductible your policy sets.

Claiming with us

A Tampa Bay glass claim, start to finish

  1. We look at your coverage

Give us the insurance company and policy number. We confirm whether comprehensive is on the policy and what, if anything, you would owe, before anything is booked.

  2. We help you file your claim

You open the claim with your insurer by phone or in its app, and we supply the glass details and our information when they ask. The claim stays yours.

  3. We set the install

At home, at work or at your apartment, Monday through Saturday, 8am to 6pm.

  4. We bill the insurer

After covered work, we bill your insurer directly. Where a deductible applies, you pay it to us; we never waive, cover or refund it.

Insurance companies

Every insurer, the same steps

We accept all insurance companies, from the national names to the Florida-only carriers. That means Progressive, GEICO, Allstate, State Farm and USAA as well as the smaller ones, and we help you file with each. Taking your insurer's claim does not mean we are partners: no insurance company endorses or recommends us, and we don't represent any of them.

Snowbird with a policy from another state? Florida's windshield rule is written for policies delivered or issued in Florida, so a policy from Ohio or New York follows its own state's glass terms. Send us the policy and we read it with you.

Florida coverage questions from Tampa

Keep your policy nearby and ring our Tampa line, (727) 270-8521. Our (877) line, (877) 994-5277, is answered 24/7.

Do I have comprehensive coverage?

Check the declarations page of your policy for comprehensive, sometimes listed as other-than-collision. If you only carry the Florida minimum of PIP and property damage liability, you don't have it. We can confirm with you before you book.

Is a windshield claim the same as a hurricane claim?

Not usually. A windshield cracked by debris after a storm is normally a comprehensive glass claim, separate from any home or flood claim. Ask your insurer how they want storm damage reported.

Will a windshield claim raise my rate?

That is a question for your insurer. We can't predict it, and none of the statutes on this page answer it.

Can a glass shop give me something in return for filing a claim?

Florida law bars glass shops from offering anything of value for making a glass claim (§ 559.920(17)). We don't offer any.

My insurer suggested its own glass company. Do I have to use it?

For windshield work on a personal auto policy, § 627.7291 says your insurer may not require a particular company or location. Check whether you accepted a discounted repair arrangement on your policy.
